This Privacy Policy (also referred to as the “Policy”) describes how Notes Frequencies, Inc. (“Notes,” “we,” “us,” or the “Company”) collects, processes, and discloses your personal information when you visit the Notes website (“Website”) and subscribe to Notes’ paid Subscription. The Website and the paid Subscription are collectively referred to as the “Services.” This Policy tells you about the rights and choices you have with respect to your personal information, and how you can reach us to get answers to your questions. 1. Personal Information We Collect and Disclose
a. Categories of Personal Information, Sources of Personal Information, and Purposes for Use
The personal information we collect about you depends on how you interact with our Services.
Information You Provide Us Directly
- Identifiers –When you register for an account on our Website, we collect your name and email address (as a username), and password for log-in purposes. When you register for a Subscription, we also collect information related to the Services from one or more services, including, without limitation, music publishers, record labels, media distributors, performing rights societies, and other organizations/parties. (“Media Platforms”).
- Messages – When you interact with us through our customer service chat bot, we collect the messages you send us in order to interact with you and respond to your inquiries.
- Login-Credentials – When you register for a Subscription, we may request and you may provide your login credentials, such as a username and password for one or more Media Platforms.
- Payment Information – Including credit or debit card numbers to process your payments for your Subscription.
Information We Collect From Other Sources
- Media Platforms - Notes will receive from Media Platforms streaming information.
Information We Collect Automatically
- Device Information and Other Unique Identifiers – including device identifier, internet protocol (IP) address, cookies, beacons, pixel tags, mobile ad identifier, or similar unique identifiers.
- Internet or Other Network Activity – When visiting (browsing) the Website, we collect information about your online activity and interaction with our Services for analytics purposes.
We do not collect Sensitive Personal Information as that term is defined under applicable US privacy laws.
b. Purpose for Collecting Your Personal Information.
We collect and use personal information for various purposes, including:
- Providing Our Services – We use your personal information to provide our Services, such as to provide you with your Subscription, to process your payments; to communicate with you, to create, maintain, and otherwise manage your account.
- Communicating With You – We use your personal information to communicate with you, such as to respond to your requests and inquiries and to provide customer services.
- Analytics – We use personal information to conduct research and analytics, including to improve our Services.
- Security and Fraud Prevention – We use personal information to detect, investigate, prevent, or take action regarding possible malicious, deceptive, fraudulent, or illegal activity, including fraudulent transactions; attempts to violate our policies or Terms of Use. We use Stripe to help verify identity and prevent fraud in connection with royalty payouts and financial account services. We share personally identifying information with Stripe, and Notes and Stripe may each act as independent controllers of such personal data for risk evaluation, identity verification, fraud prevention, and compliance purposes. Stripe processes this information in accordance with Stripe's Privacy Policy.
- Legal Obligations – We use personal information to comply with our legal or regulatory obligations, to establish or exercise our rights, and to defend against a legal claim.
c. Disclosing Your Personal Information:
- Service providers – We may disclose your personal information with entities that provide services on our behalf or help us operate the Services.
- Payment Processor (Stripe). Notes uses Stripe, Inc. and its affiliates ("Stripe") to provide payment processing, connected account onboarding, royalty payouts, identity verification, tax reporting support, and financial account services. When you provide personal information in connection with these services, or when we share such information with Stripe to enable them, Stripe may process your personal information as an independent controller for certain purposes, including identity verification, fraud prevention, regulatory compliance, and service operations, in accordance with Stripe's Privacy Policy (https://stripe.com/privacy). We may also share information about you, your business, and your transactions with Stripe and its financial institution partners as necessary to provide these services.
- Distribution Partners. Notes distributes music on behalf of users via distribution partners, currently LabelGrid and Spotify ("Distribution Partners"). In connection with these distribution services, Notes shares recording metadata and user identity information with its Distribution Partners for distribution and royalty reporting purposes. Notes and its Distribution Partners each act as independent data controllers for their respective processing activities under applicable data protection laws. Notes is responsible for the personal data it shares with these third parties. In the event of a personal data breach affecting data shared with a Distribution Partner, Notes will notify such Distribution Partner without undue delay. Users may request takedown of their data in accordance with applicable law by contacting us using the information provided in this Privacy Policy.
- Data Analytics Companies – We may disclose your personal information with our analytics providers.
- In Accordance with Laws – To comply with applicable law or respond to valid legal process (including from law enforcement, other government agencies, the courts or others)
- Corporate Transactions – We may disclose your personal information as part of a proposed or completed corporate transaction or proceeding such as a merger, financing, acquisition, bankruptcy, dissolution or proceedings involving a transfer, divestiture, or sale of all or a portion of our business or assets.
2. Retaining Your Personal Data
Except where permitted or required by law or to resolve disputes, we will retain your personal information as long as necessary to fulfill the purposes for which we collected it. In determining the retention period, we consider legal requirements, the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process your personal information, and whether those purposes can be achieved through other means.
3. Sell, Share, Targeted Advertising
We do not “sell” or “share” your personal information for monetary consideration, but we use your personal information for analytics purposes and may transmit your information to our service providers for such purpose. Notes does not have actual knowledge that it sells or shares the personal information of consumers under 16 years of age.
4. Your Rights
You may have certain rights and choices regarding our processing of your personal information. Depending on your jurisdiction, applicable law may entitle you to additional rights, such as the right:
- To know the categories and/or specific pieces of personal information collected about you, including the source of your personal information, whether your personal information is sold or disclosed and the purpose, and with whom your personal information was disclosed;
- To request deletion of personal information, if permissible by law;
- To correct inaccurate personal information we retain about you;
- To opt-out of “sale” and/or “share” of your personal information, targeted advertising, and profiling
- To limit the use of your sensitive personal information;
- To nondiscrimination based on the exercise of a consumer’s privacy rights; and
- To appeal a decision regarding your request
a. Exercising Your Right to Know, Delete and Correct. Depending on where you live, you may exercise the right to know, delete, and correct your personal information. To exercise these rights, submit a request by contacting us using the contact information at the end of this Privacy Policy. If you are located in Canada, our payment processor can obtain information from credit agencies to verify your identity. That information will be used for the purposes described in the payment processor's Privacy Policy (https://stripe.com/privacy).
b. Opt-Out of Sale, Share, and Targeted Advertising.
We do not sell or share your personal information, therefore, we do not offer opt-out of sale and/or share.
Unsubscribe. You can stop receiving promotional e-mails at any time by clicking on the “unsubscribe” link at the bottom of any promotional e-mail that you receive from us.
c. Right to Limit the Use of Your Sensitive Personal Information or Opt-Out of Processing of Sensitive Personal Information
We do not collect your sensitive personal information. Therefore, we do not offer the right to limit the use of sensitive personal information.
d. Right to Appeal a Decision. Depending on where you live, you may have the right to appeal requests that have been denied by contacting us at privacy@notes.fm.
e. Right to Non-Discrimination. We do not discriminate against you for exercising the rights described in our privacy policy.
5. Verifying Your Identity
For us to process some requests, we will need to verify your identity to confirm that the request came from you.
6. Submitting a Request through an Authorized Agent
Depending on your state of residence in the U.S., you may designate an authorized agent to submit a request on your behalf to access or delete your personal information. To do so, you must: (1) provide that authorized agent written and signed permission to submit such request; and (2) verify your own identity directly with us. Please note, we may deny a request from an authorized agent that does not submit proof that they have been authorized by you to act on your behalf.
We reserve the right to deny your request if we cannot verify your identity. Where we deny your request in whole or in part, we will inform you of the denial, provide an explanation of our actions, and the reason(s) for the denial.
7. Children and Minors
Our website is not intended for or directed at children under the age of 13. We do not knowingly collect or use any information from consumers younger than 13 years of age. We do not knowingly collect personal information directly from children under the age of 13 without parental consent. If we become aware that a child under the age of 13 has provided us with personal information, we will delete the information from our records.
8. California’s “Shine the Light” Law
If you are a California resident, you are entitled, once a year, free of charge, to request information regarding our disclosure, if any, of certain categories of personal information to third parties for their direct marketing purposes in the preceding calendar year.
9. Amendments
We reserve the right to amend this Policy at any time. When we do revise this Policy, we will update the “Last Updated” date at the top of this page so that you can tell if it has changed since your last visit. The effective date of this Policy is the date in which this Policy went into effect.
